1. Acceptance
By creating an account or using FishingSpree, you agree to these Terms. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization.
2. Platform Description
FishingSpree is a tournament management platform operated by ClickingSpree, LLC. We provide tools for organizing fishing tournaments, registering teams, recording catches, and processing payments. We are not a party to disputes between organizers and participants.
3. Platform Fee
The platform charges $5.00 USD per registered angler per tournament. This fee is collected at registration checkout. Stripe payment processing fees (2.9% + $0.30 per transaction) are separate and passed through to the organizer. Platform fees are non-refundable.
4. Organizer Responsibilities
Tournament organizers are responsible for the conduct of their events, compliance with applicable fishing regulations, accurate prize payout to winners, and collection of required tax documentation (W-9). FishingSpree provides tools but does not oversee event operations.
5. Prohibited Use
You may not use FishingSpree to submit fraudulent catch data, impersonate other anglers, manipulate leaderboard results, or violate any applicable laws including fishing regulations. Violations may result in immediate account termination.
6. Payouts
Prize payouts are processed via Stripe Connect. Recipients must complete W-9 verification before receiving funds. Payouts are subject to review and approval by tournament organizers and ClickingSpree. We are not liable for organizer failures to fund prize pools.
7. Intellectual Property
You retain ownership of catch photos and data you submit. By submitting content, you grant FishingSpree a license to display that content to tournament participants and organizers as part of the tournament operation.
8. Limitation of Liability
FishingSpree is provided "as is." ClickingSpree's liability is limited to the platform fees you paid in the 90 days preceding a claim. We are not liable for lost prizes, event cancellations, or third-party service outages.
9. Governing Law
These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved by binding arbitration in Manatee County, Florida.
